You cannot always control what type of divorce proceeding you have. Perhaps you would like to consider collaborative divorce, but your spouse will not. Maybe you have many assets to divide that will complicate the divorce.

Perhaps you would like to agree on the terms of the divorce and are even willing to let them have the greater share of the property, be the primary custodian or the children, and agree to pay child support to them. Your spouse, however, wants you to agree to a child support amount that is over half of your paycheck, visitation with your children when they allow it, and to keep 90% of the community property, do you still want to agree? 

Probably not – the court is unlikely to give you a deal as bad as that.  

In this case and others like it, you may be left with only one choice – traditional divorce. You may have to fight to keep the relationship with your children that you have built and the financial resources you need.

 Traditional divorce does not mean that you will not ultimately come to an agreement, but it may require going through court hearings, the discovery process, mediation, and possibly trial. 

Traditional divorce also does not mean that it is a good idea to hire the meanest lawyer in town. Although the cost of a traditional divorce is more difficult to predict and to control, hiring a lawyer who knows the family code, uses necessary processes and tools, avoids unnecessary ones, and keeps your goals in mind while trying to reach the best resolution for you can certainly be a more money smart decision than hiring the meanest lawyer you can find.
